The Department of the Environment (“the Department”) is seeking views on its proposed approach to property seizure which will result from the introduction of proposed new Regulations. These will set out procedures to govern the seizure of vehicles and their contents (“seized property”) that are suspected of being used in illegal waste activity in Northern Ireland.
The new Regulations are designed to give effect to the powers recently introduced by way of the Waste (Amendment) (Northern Ireland) Order 20071 (“the 2007 Order”) and in the Waste and Contaminated Land (Amendment) Act (Northern Ireland) 20112 (“the 2011 Act”), which give the Northern Ireland Environment Agency (NIEA) and in some cases the Police, more effective tools to use against actual and suspected offenders and also to act as an effective deterrent to waste crime.
